Limited Liability Warranty and Disclaimer of Liability

Product Covered: Emergency Tree Jack
1. Limited Warranty
Tree Tech Tools (“Company”) warrants to the original purchaser (“Purchaser”) that the Emergency Tree Jack product (“Product”) shall be free from defects in material and workmanship under normal, intended, and proper use for a period of one (1) year from the date of original retail purchase (“Warranty Period”).
If a defect in material or workmanship arises during the Warranty Period, the Company will, at its sole discretion, either repair or replace the defective Product. Ship the broken part to Emergency Tree Jack to receive a repair or replacement. The customer is responsible for all shipping costs. This is the sole and exclusive remedy under this Limited Warranty.
2. Exclusions and Limitations
This Limited Warranty does not cover:
- Damage resulting from misuse, abuse, neglect, or improper application;
- Use in a manner inconsistent with the Company’s instructions, warnings, or safety guidelines;
- Unauthorized modifications, disassembly, or repair attempts;
- Normal wear and tear or cosmetic damage;
- Damage caused by accidents, environmental conditions, or acts of God.
3. Assumption of Risk and Limitation of Liability
WARNING: Emergency Tree Jack™ is a heavy-duty tool designed for professional use in high-risk situations such as tree removal and structural stabilization. Improper or untrained use may result in serious injury, death, or property damage.
By purchasing or using this Product, the user acknowledges and agrees that:
- They are solely responsible for determining the appropriateness and safe use of the Product;
- They assume all risks associated with use, including injury, death, and property damage;
- The Product must only be used by trained, qualified individuals.
To the fullest extent permitted by law, Emergency Tree Jack, its owners, officers, employees, contractors, agents, distributors, and affiliates shall not be liable for any direct, indirect, incidental, special, consequential, or punitive damages whatsoever, including but not limited to personal injury, death, property damage, business interruption, loss of data, or loss of income or profits, arising from or related to the use or misuse of the Product.
4. Disclaimer of Other Warranties
Except as expressly provided above, the Company disclaims all other warranties, express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement. No oral or written information or advice provided by the Company or its representatives shall be deemed to create any additional warranty.
5. Claims Process

- Proof of purchase;
- A written description of the issue;
- Relevant photos or documentation.
The Company will evaluate the claim and respond at its sole discretion.
6. Governing Law
This Limited Warranty and Disclaimer shall be governed by and interpreted in accordance with the laws of the State of Georgia, without regard to any conflict of law provisions.
7. Severability
If any provision of this Warranty is held to be invalid, illegal, or unenforceable, the remaining provisions shall remain in full force and effect.
Use of this product constitutes full acceptance of the terms and conditions outlined above.
